International Emergency Economic Powers Act (IEEPA), is a power vested in the hands of the US President that has always posed a risk to fair global trade. The act was used by the President of the US according to the political situation of the country, which always disrupts the market significantly. The US Supreme Court's 6-3 ruling has struck down the emergency way of tariffs, it drew a definitive line that limits the presidential power, of using the 1970 emergency law loophole which bypasses the Congress decision on trade and tariffs.
What is IEEPA ?
The International Emergency Economic Powers Act (1977) gives the US President quick economic powers under the pretext of national emergency.
It has been used to freeze bank accounts of foreign dictators, freeze the funding of terrorist organisations, impose economic sanctions, freeze foreign assets etc.
The key idea of IEEPA was to protect the country from emergency situations like 9/11, where the security of the country is at risk from terrorism or hostile foreign entities. But gradually the act shifted from being an emergency protocol to the President's tool for US economic statecraft.
The Ruling of Supreme Court
In February 2026 there was a landmark verdict by the US Supreme Court which invalidated the Presidential tariffs under the International Emergency Economic Powers Act.
The verdict was delivered in the case ‘Learning Resources,Inc vs Trump’. The ruling of the Supreme Court was that IEEPA grants the president emergency powers, but the president cannot impose tariffs unilaterally.
The supreme court stated in its verdict that :

Regulating does not mean Taxing, it can affect small scale industries which do not have any connection with the political situation.

Higher risk in supply chain - The uncertainty in the market which these acts bring can affect the supply chain and these factors lead to the rethinking of long term investments.
What lead to the imposition of IEEPA
Historically, the IEEPA was used as a shield to protect the country during the situation of ‘National Emergency’. But gradually the shield turned into a sword in the hands of the US President by turning the emergency act into an economic tool for political conditions. The condition which lead to the imposition of the IEEPA by President Trump are as follows :

US Trade deficit - The trade imbalance of the US with other countries like India, China etc lead to the imposition of tariffs on the imports from these countries.

Illegal Migration - The illegal Migration from neighbouring countries like Mexico and Canada which affect the citizens of America in getting jobs etc.

Infusion of drugs into America - The infusion of narcotics from neighbouring countries also lead to the imposition of tariffs as drugs are becoming one of the greatest challenges to the super power and the drug economy is increasing year by year.
Following all these reasons, the Trump administration imposed humongous tariffs on several countries, arguing that all these conditions if persisted can lead to a situation of emergency.
What Led to the Controversy?
Historically, the IEEPA was used to freeze foreign assets, impose sanctions and stop financial transactions. But the Trump administration used the act to impose a wide range of tariffs on several countries, which was not part of the economic power which the Congress gave to the president. The use of IEEPA for imposition of tariffs was beyond the executive power and there are special trade laws for addressing the imposition and removal of tariffs. This led to the challenging of the tariffs in court by many business groups.

Redefining of power - The ruling of the court narrowed the power of president's power in the emergency act, it made clear that invoking the act has certain legal jurisdiction.

Role of Congress - The ruling of the supreme court increased the role of Congress in approving such restrictions.

Legal uncertainty - There will be uncertainty in the trade market as the tariffs and sanctions by the President can always be challenged in the court. It can lead to legal uncertainty in trade.

Difficulty in maintaining Balance - The ruling makes it difficult to maintain a stability in Swift response in national emergency and the response being challenged in courts and get looped in legal restraints.

Reduction of Tariffs - The IEEPA tariffs have affected Indian exporters, the involvement of Congress in the decision making of tariffs will certainly provide a certainty for the exporters

Increase in Cooperation in Manufacturing - Greater predictability in decision making in the US trade market can help India to attract FDI in manufacturing sectors.

Opportunity in Supply Chain Diversification - as the companies based in the US tend to move their production base from China, India can be an alternative destination for these companies. A predictable trade policy of the US would help the multinational corporations to expand operations under policies like “china + 1”.
Way Forward
The ruling of the Supreme Court on IEEPA shows that there should be careful scrutinization for creating a balance between national security and economic predictability. The future of international trade will not only depend on the economic strategy but also the predictability of the law and the treaties of the country. The decision also establishes a differentiation of power and it also reinforces the accountability of the decision taken in the economic sector. The ruling can be advantageous for countries like India by diversifying its global trading system. It can help in strengthening its manufacturing capabilities and help in bilateral trade agreements.
